FOREIGN MILITARY EXPORT PROGRAM

Thank you for your interest in our line of Defense Articles.  Our Company is a contract Designer and Manufacturer of automatic weapons, weapon sound suppressors, Crew-Served Weapon Systems, Armor-Piercing Ammunition, Destructive Devices and Explosives.  We currently are distributors for ALL manufacturer's models including DPMS, LWRC, STAG, BUSHMASTER, COLT, FNH, HK, BERETTA and BENELLI

Prices are based on the quantity level at which EACH model of weapons system is ordered/received per order. Example:

  • 10 FNH MK46 MOD 0 Light Machine Gun units ordered/received at one time would be @ the 10 piece level.
  • 5 STAG Arms STAG-16 units plus 5 HK UMP-40 SMG units would be @ the 3 piece price level of either product even though the total order was 10 pieces
  • Our highest quantity price level is 100 pieces.

We recommend you fax or mail us a "Blanket Order" for a number of the weapons, spare magazines and parts you may order in the future so we may apply for an Export License from our U.S. Department of State against which we may ship smaller amounts you request immediately upon receipt of payment.  This will eliminate the 8 - 12 week delay the receipt of export approval requires each time you reorder and thereby expedite shipment of these follow up orders.

Typically, as with our other foreign customers, we suggest the following format:

  • 200 pcs. Colt M-16A3 Assault Rifles
  • 600 pcs. spare Magazines for above rifles
  • Misc. spare parts for above rifles as required

This "Blanket" approval is good for four (4) years.  We will only ship the smaller amounts you request and pay for.  The amount of export paperwork and related effort is the same for 3 pieces as for hundreds therefore when we get ready to apply for the Export Permit application, it should be a "blanket" quantity to cover future orders.

Orders should be on Government Agency letterhead or order form to facilitate the application and receipt of the Export License from our Department of State.  Our Department of State requires you to provide "Certified" copies of approved import permit and completed, signed DSP-83, "End User Certificate" to be included with our application for export permit.  This permit should be for the larger quantities, as noted above, thereby eliminating the need to apply for additional export permits for the next 4 years.

The following are REQUIRED for application and receipt of Export License from our Department of State

1)  Purchase order on Government letterhead or Purchase Order form.  Faxed copy is acceptable.

2)  Original or "certified" copies of approved import permit from your government.  Must have "certified" translation into English if in another language.  Faxed copies NOT acceptable.

3)  Completed, signed DSP-83, "End User Certificate".  Items 2, 3, 4, 5, 6, & 7 MUST be completed by the sender.  Faxed copy is acceptable.

4)  Payment of the $350.00 application fee PRIOR to our applying for the export permit.
 

Due to the fact that our Department of State has massively increased our registration fee, we have a $350.00 DSP-5 application fee EACH time we apply for permit.  If you prefer to apply for the permit yourselves or have a permit specifically listing these products, provide a certified copy with your formal order for our records.  Our fee then lowers to $250.00.

All orders must be prepaid before shipment.  Prices are FOB New York, New York USA.  When you fax us request for the smaller shipments against the "Blanket Order", we will fax back our "Proforma Invoice" for you to wire or mail us payment.  Shipping charges for that order's quantity will be included if by Air Freight.  Be advised the U.S. Air Freight System in some instances may not be a good choice as they have no control over intermediate countries (Germany) the shipment may pass thru.

We also use several international air freight forwarders for larger shipments.  Their charges are "collect" and are very reasonable.  The choice of a freight forwarder is critical as the Airlines and officials in several intermediate countries (Germany) are getting very troublesome (since Sept 11) about firearm related shipments even just passing thru their Country.

Unfortunately due to past bad experiences we are unable to offer exclusive rights to any one for any country.  We will however direct all sales inquiries from that country to our chosen representative as long as that representative properly handles our products.

Last but certainly not the least item of importance is that these weapon systems, magazines and spare parts are considered by our U.S. Department of State to be Category 1(A) Munitions List items.  Their export and subsequent diversion is controlled and must be licensed by them.

D-Trade / Licensing Update: Only D-Trade Electronic Submissions After January 31, 2007
As of January 31, the following application forms, which include the new D-Trade Amendment forms, will only be accepted via D-Trade:

DSP-6 DSP-5 Amendment
DSP-83- remains unchanged
The ELLIE system, which allowed the submission of the DSP-119 Amendment form, will also be discontinued. Any DSP-119 Amendment application received after January 31 will not be processed. Applicants will be required to use the new D-Trade DSP-6, DSP-62 or DSP-74 form.
Submissions NOT affected by this coming change include: DSP-85 (Application/License for Permanent/Temporary Export or Temporary Import of Classified Defense Articles and Classified Technical Data), General Correspondences (GCs), Agreements/Amendments (AGs, TAAs, MAs, DAs), and Brokering Requests (BAs).

The AECA, among these other requirements and authorities, provides for the promulgation of implementing regulations, the International Traffic in Arms Regulations (ITAR) (22 CFR 120-130). Important Export Restrictions Warning!

  1. Export of some night vision equipment and accessories, thermal imaging equipment and accessories, optical sighting equipment and accessories, and tactical lights and accessories, tactical gear and weapon accessories, knives, tactical helmets, military apparel, and some electronic devices is strictly prohibited without a valid export license issued by the U.S. Department of State, in accordance with International Traffic in Arms (ITAR), Title 22, Code of Federal Regulations Part 120-130.
  2. U.S. law prohibits the sale, transfer, or export of items to Embargoed Countries and entities on the Department of State's List of Debarred Parties, the Department of Commerce's Denied Persons List, and the Department of the Treasury's Specially Designated Nationals and Blocked Persons List. It is the Buyer's responsibility to be aware of the Lists of Embargoed Countries, Debarred Parties, Denied Persons, and Specially Designated Nationals and Blocked Persons. These Lists can be found at the U.S. Government websites listed below.

§123.17   Exports of firearms, ammunition, and personal protective gear (i.e. Body Armor).

(a) Port Directors of U.S. Customs and Border Protection shall permit the export without a license of:

(1) Parts and components for USML Category I(a) firearms, except barrels, cylinders, receivers (frames), or complete breech mechanisms, when the total value does not exceed $100 wholesale in any transaction, except to any of the countries or entities as provided in §126.1 of this subchapter;

(2) Parts, components, accessories, or attachments for USML Category I firearms, except barrels, cylinders, receivers (frames), complete breech mechanisms, or fully automatic firearms and parts and components for such firearms, when:

(i) The total value does not exceed $500 wholesale in any transaction;

(ii) The export is to Canada for end-use in Canada or return to the United States, or temporary import into the United States of Canadian-origin items and return to Canada for a Canadian citizen; and

(iii) The exporter makes a declaration via the Automated Export System, pursuant to §123.22(a) of this subchapter, and the exporter is eligible to export under this exemption, pursuant to §120.1(c) of this subchapter; or

(3) Parts, components, accessories, or attachments for USML Category I firearms, including fully automatic firearms and parts and components for such firearms, when:

(i) The total value does not exceed $500 wholesale in any transaction;

(ii) The export is to Canada for end-use by the Canadian Federal Government, a Canadian Provincial Government, or a Canadian Municipal Government; and

(iii) The exporter makes a declaration via the Automated Export System, pursuant to §123.22(a) of this subchapter, and the exporter is eligible to export under this exemption, pursuant to §120.1(c) of this subchapter.

(b) Port Directors of U.S. Customs and Border Protection shall permit the export without a license of nonautomatic firearms covered by Category I(a) of §121.1 of this subchapter if they were manufactured in or before 1898, or are replicas of such firearms.

(c) Port Directors of U.S. Customs and Border Protection (CBP) shall permit U.S. persons to export temporarily from the United States without a license not more than three nonautomatic firearms in Category I(a) of §121.1 of this subchapter and not more than 1,000 cartridges therefor, provided that:

(1) The person declares the articles to a CBP officer upon each departure from the United States, presents the Internal Transaction Number from submission of the Electronic Export Information in the Automated Export System per §123.22 of this subchapter, and the articles are presented to the CBP officer for inspection;

(2) The firearms and accompanying ammunition to be exported is with the individual's baggage or effects, whether accompanied or unaccompanied (but not mailed); and

(3) The firearms and accompanying ammunition must be for that person's exclusive use and not for reexport or other transfer of ownership. The person must declare that it is his intention to return the article(s) on each return to the United States. The foregoing exemption is not applicable to the personnel referred to in §123.18 of this subchapter.

(d) Port Directors of U.S. Customs and Border Protection shall permit a foreign person to export without a license such firearms in Category I(a) of §121.1 of this subchapter and ammunition therefor as the foreign person brought into the United States under the provisions of 27 CFR 478.115(d). (The latter provision specifically excludes from the definition of importation the bringing into the United States of firearms and ammunition by certain foreign persons for specified purposes.)

(e) Port Directors of U.S. Customs and Border Protection shall permit U.S. persons to export without a license ammunition for nonautomatic firearms referred to in paragraph (a) of this section if the quantity does not exceed 1,000 cartridges (or rounds) in any shipment. The ammunition must also be for personal use and not for resale or other transfer of ownership. The foregoing exemption is also not applicable to the personnel referred to in §123.18.

(f) Port Directors of U.S. Customs and Border Protection (CBP) shall permit U.S. persons to export temporarily from the United States without a license one set of body armor covered by U.S. Munitions List Category X(a)(1), which may include one helmet covered by U.S. Munitions List Category X(a)(6), or one set of chemical agent protective gear covered by U.S. Munitions List Category XIV(f)(4), which may include one additional filter canister, provided:

(1) The person declares the articles to a CBP officer upon each departure from the United States, presents the Internal Transaction Number from submission of the Electronic Export Information in the Automated Export System (AES) per §123.22 of this subchapter, and the articles are presented to the CBP officer for inspection;

(2) The body armor, which may include a helmet, or chemical agent protective gear, which may include one additional filter canister, to be exported is with the individual's baggage or effects, whether accompanied or unaccompanied (but not mailed); and

(3) The body armor, which may include a helmet, or chemical agent protective gear, which may include one additional filter canister, to be exported is for that person's exclusive use and not for reexport or other transfer of ownership. The person must declare it is his intention to return the article(s) to the United States at the end of tour, contract, or assignment for which the articles were temporarily exported.

(g) The license exemption set forth in paragraph (f) of this section is available for the temporary export of body armor or chemical agent protective gear for personal use to countries listed in §126.1 of this subchapter provided:

(1) The conditions in paragraph (f) of this section are met; and

(2) The person is affiliated with the U.S. Government traveling on official business or is traveling in support of a U.S. Government contract. The person shall present documentation to this effect, along with the Internal Transaction Number for the AES submission, to the CBP officer.

(h) The license exemption set forth in paragraph (f) of this section is available for the temporary export of body armor, which may include a helmet, or chemical agent protective gear, which may include one additional filter canister, for personal use to Iraq, provided the conditions in paragraph (f) are met, and the person is either affiliated with the U.S. Government traveling on official business or is traveling in support of a U.S. Government contract, or is traveling to Iraq under a direct authorization by the Government of Iraq and engaging in activities for, on behalf of, or at the request of, the Government of Iraq. The person shall present documentation to this effect, along with the Internal Transaction Number for the AES submission, to the CBP officer. Documentation regarding direct authorization from the Government of Iraq shall include an English translation.

(i) The license exemption set forth in paragraph (f) of this section is available for the temporary export of body armor, which may include a helmet, or chemical agent protective gear, which may include one additional filter canister, for personal use to Afghanistan, provided the conditions in paragraph (f) are met.

(j) If the articles temporarily exported pursuant to paragraphs (c) and (f) through (i) of this section are not returned to the United States, a detailed report must be submitted to the Office of Defense Trade Controls Compliance in accordance with the requirements of §127.12(c)(2) of this subchapter.

(k) To use the exemptions in this section, individuals are not required to be registered with the Department of State (the registration requirement is described in part 122 of this subchapter). All other entities must be registered and eligible, as provided in §§120.1(c) and (d) and part 122 of this subchapter.

§123.18   Firearms for personal use of members of the U.S. Armed Forces and civilian employees of the U.S. Government.

The following exemptions apply to members of the U.S. Armed Forces and civilian employees of the U.S. Government who are U.S. persons (both referred to herein as personnel). The exemptions apply only to such personnel if they are assigned abroad for extended duty. These exemptions do not apply to dependents.

(a) Firearms. Port Directors of U.S. Customs and Border Protection shall permit nonautomatic firearms in Category I(a) of §121.1 of this subchapter and parts therefor to be exported, except by mail, from the United States without a license if:

(1) They are consigned to servicemen's clubs abroad for uniformed members of the U.S. Armed Forces; or,

(2) In the case of a uniformed member of the U.S. Armed Forces or a civilian employee of the Department of Defense, they are for personal use and not for resale or other transfer of ownership, and if the firearms are accompanied by a written authorization from the commanding officer concerned; or

(3) In the case of other U.S. Government employees, they are for personal use and not for resale or other transfer of ownership, and the Chief of the U.S. Diplomatic Mission or his designee in the country of destination has approved in writing to Department of State the import of the specific types and quantities of firearms into that country. The exporter shall provide a copy of this written statement to the Port Director of U.S. Customs and Border Protection.

(b) Ammunition. Port Directors of U.S. Customs and Border Protection shall permit not more than 1,000 cartridges (or rounds) of ammunition for the firearms referred to in paragraph (a) of this section to be exported (but not mailed) from the United States without a license when the firearms are on the person of the owner or with his baggage or effects, whether accompanied or unaccompanied (but not mailed).

CATEGORY I—FIREARMS, CLOSE ASSAULT WEAPONS AND COMBAT SHOTGUNS

* (a) Nonautomatic and semi-automatic firearms to caliber .50 inclusive (12.7 mm).

* (b) Fully automatic firearms to .50 caliber inclusive (12.7 mm).

* (c) Firearms or other weapons (e.g. insurgency-counterinsurgency, close assault weapons systems) having a special military application regardless of caliber.

* (d) Combat shotguns. This includes any shotgun with a barrel length less than 18 inches.

* (e) Silencers, mufflers, sound and flash suppressors for the articles in (a) through (d) of this category and their specifically designed, modified or adapted components and parts.

(f) Riflescopes manufactured to military specifications (See category XII(c) for controls on night sighting devices.)

* (g) Barrels, cylinders, receivers (frames) or complete breech mechanisms for the articles in paragraphs (a) through (d) of this category.

(h) Components, parts, accessories and attachments for the articles in paragraphs (a) through (g) of this category.

(i) Technical data (as defined in § 120.10 of this subchapter) and defense services (as defined in § 120.9 of this subchapter) directly related to the defense articles enumerated in paragraphs (a) through (h) of this category.

Technical data directly related to the manufacture or production of any defense articles enumerated elsewhere in this category that are designated as Significant Military Equipment (SME) shall itself be designated SME.

(j) The following interpretations explain and amplify the terms used in this category and throughout this subchapter:

(1) A firearm is a weapon not over .50 caliber (12.7 mm) which is designed to expel a projectile by the action of an explosive or which may be readily converted to do so.

(2) A rifle is a shoulder firearm which can discharge a bullet through a rifled barrel 16 inches or longer.

(3) A carbine is a lightweight shoulder firearm with a barrel under 16 inches in length.

(4) A pistol is a hand-operated firearm having a chamber integral with or permanently aligned with the bore.

(5) A revolver is a hand-operated firearm with a revolving cylinder containing chambers for individual cartridges.

(6) A submachine gun, ‘‘machine pistol’’ or ‘‘machine gun’’ is a firearm originally designed to fire, or capable of being fired, fully automatically by a single pull of the trigger.

NOTE: This coverage by the U.S. Munitions List in paragraphs (a) through (i) of this category excludes any non-combat shotgun with a barrel length of 18 inches or longer, BB, pellet, and muzzle loading (black powder) firearms.

This category does not cover riflescopes and sighting devices that are not manufactured to military specifications. It also excludes accessories and attachments (e.g., belts, slings, after market rubber grips, cleaning kits) for firearms that do not enhance the usefulness, effectiveness, or capabilities of the firearm, components and parts.
